I would never use a term like “Croat Nat” but just the use of the term does not automatically infer that it is derogatory?

If she was offended she would have dealt with it by now.

If I called anyone at work “Corat Nat” or some derivative based on nationality I would be fired. Enough with the contrarian viewpoints. It’s ridiculous to label someone based on ethnicity or where they’re from particularly in the workplace.

No, not automatically. But under the Act it could “reasonably be likely to offend, insult or humiliate”.
Employers can also be held liable if they don’t take reasonable steps to prevent other staff from being exposed to it.

It’s not just whether she is offended or not. If you read the Act it’s whether others might be offended. E.g. other Croatians. And as it is said in the public arena that makes it worse.

Anyway, you don’t need to believe me, try it for yourself in your workplace or ask HR.

Dude, relax. I’m just explaining the legislation. No need to take it personally. What I said is it wouldn’t be acceptable in any corporate environment in Australia, and it wouldn’t. End of story.

ARN is a corporate company in Australia and they clearly don’t have a problem with it.

He currently isn’t breaking any regulations though. He may talk filth and people don’t like that but he isn’t breaking anything so ARN don’t need to have a problem with him.

It’s clearly ‘acceptable’ at ARN though - and I’m sure there’d be others where this would happen. Brit (Pom), Kiwi, American. Any kind of prefix that includes the country. Not saying it’s right - but there’s probably a likelihood it’s going to create less offence when it’s a white person involved.

There is a fine line, but really look through the list of producers etc and most of their nicknames are (imho) much more offensive (Lingus for a producer whose last name is Kanna for example). I know the legislation but if you’re going to pin them on Croat Nat, it’s like Al Capone when he was got on tax evasion.

All that shows is that ARN play far more fast and loose than most corporates in Australia. It doesn’t say much for their corporate culture or compliance, but it’s also not surprising in the FM radio industry, and media in general. And one day it could very easily bite them in a future claim or court case.

I think ARN needs to wrestle control back of the breakfast slot first - it’s clear they’re not in the driver’s seat and it should be ringing huge risk alarms at ARN HQ, there are possibly some significant issues around governance here too.
