To people who know more about podcast deals and contract negotiations than me… What do you think went down here? Has anyone acted improperly? Or is this normal when someone ends a podcast deal?

‘Callous and punitive’: Rosie Waterland launches own podcast network after battle with SCA

Award-winning podcaster Rosie Waterland has launched her own podcast network and will re-record old episodes after an ongoing dispute with SCA’s Listnr was finally resolved.

In various statements, Waterland has labelled the actions of Listnr “pointlessly callous and punitive”, and called on her listeners to use her network’s launch as an opportunity to “prove to the men in suits who co-opt the work of artists and creators that we can be bigger, and better, without them”.

Waterland had two podcasts with Listnr, Just The Gist and Mum Says My Memoir Is A Lie. When the deal with Listnr was dissolved, Waterland was unaware that she didn’t own the master recordings, or that she’d be unable to use the successful podcasts’ feeds.

The article suggests something has gone down, but I’m not sure whether that’s particularly relevant or not - it seems like someone didn’t read their contract thoroughly enough, or didn’t ask enough questions before signing. I’d imagine these podcast networks/aggregators (whatever you want to call them) would have in their standard contracts that they control the IP that is produced

To my understanding, there are 2 types of deals.

The first is where the podcast network simply distributes the podcast. This means that the podcast is recorded and produced offsite, and the network distributes it and sells advertising on it, and the creators get paid a share of the advertising revenue. The risk is predominantly on the creator as they don’t get paid if it tanks. This is what Rosie has now with Acast.

The second is where the podcast network actually produces the podcast. The creators are generally paid more like an employee (but it could also be on a revenue share basis). The podcast network will provide production staff to assist with content, editing, audio grabs, branding etc. The creator still gets paid if it tanks so it’s the podcast network taking the risk. This is what Rosie had with LiSTNR. Under this type of deal it’s rare for the creator be entitled to own the final product because they haven’t contributed 100% to it.

“I had no idea I didn’t fully own my own creative work to begin with”

Someone didn’t read the contract.

That was my first thought.

I get it. You have created something amazing and decide to team up with someone who will promise you bums on seat, until you realise they want you to go down a different direction.

It’s their money and you can’t do anything about it. I just wonder if it was better to cop it on the chin and move on. Guess we’ll never know!

That’s the catch with these platforms like iHeart, NOVA Podcasts and LiSTNR. The major networks give you a LOT more publicity and promotion and traffic to their platforms, but of course there’s always a catch.

These podcast networks don’t operate on benevolent terms either - they are there to make money.

I think it’s a tad unfair to say there is a ‘catch’ with them - anyone working with them is doing so under commercial terms.

Well clearly this podcaster mustn’t had been aware of it.
