I wonder how many news reports will go into the detail of the High Court’s decision like this piece:
In their full reasons, the High Court concluded an independent assessment of the evidence by the Court of Appeal should have concluded there ought to have been sufficient doubt in the jury’s minds to preclude the verdict from being open.
They also found that despite the complainant’s credibility and reliability, the evidence of the witnesses required the jury, acting rationally, to have entertained a reasonable doubt as to Pell’s guilt.
It is difficult to reconcile this outcome with the fact this is exactly the conclusion the jury did make. The jury’s conclusion was further supported by the Appeal Court majority judgment’s careful and extensive evaluation of that same evidence.
The High Court has given claims about lack of opportunity an elevated technical legal status that outweighs the jury’s belief in the complainant’s testimony and their evident discounting of Pell’s claimed lack of opportunity. This appears perilously close to retrial by the court.
The jury saw and heard all the evidence, in the context of the trial. It was their legal function to make this decision.
Careful analysis of the full reasoning of the High Court is required to fully assess it. But, for now, this extraordinary outcome is strange justice indeed.
This judgement is worrisome; to overturn a jury conviction like this risks causing (further) distrust in the independent administration of justice. I worry for victims of not only this case but so many others, and can begin to imagine some conspiracy theories which may well appear on social media resulting from this HC decision.
A terribly sad day for victims of sexual abuse.

I turned on ABC News 24 and saw their helicopter shot of Pell’s car occupying the bottom right corner of the screen.
They should know better than to stoop to that level.

It really is and if the Victorian justice system got it right in the first place they wouldn’t have needed to go through this for over 3 years.

I was impressed that the vic appeals court judges visited the cathedral and tried on the robes to fully test Pells defense for themselves. It seems that didn’t happen with the high court and it was more of a desktop investigation. upsetting that it seems the higher the stakes the less thorough.
If by ‘getting it right’ you mean finding him not guilty, I think the victims would rather he spend 400 days in prison than none.

A completely inaccurate statement. What alleged victim wants to think they were not believed? Have to have their alleged offended brought up so often over 3 years? Had this thrown up all over the media and had dickheads like Bolt say they are all liars. Look at the bigger picture here MrJ.

Yes, there was total silence. I had been wondering what had happened to the trial and had assumed it had been delayed. It was only when the verdict leaked that I knew anything about it.
I think the ban on reporting may have happened in May 2018, although a few media outlets were saying “there’s a really major story we’re not allowed to talk about but you’ve probably heard about on the internet” in December 2018 before everyone was able to report on the guilty verdict in February 2019.

The big question now is will that moron Bolt hyperventilating tonight given this verdict. He will attack the ABC, David Marr and the Guardian and any other media outlet that in his view pre-judged his precious Pell. What an awful awful man.

Court decisions like today’s will be hard enough without the likes of Bolt adding to victims’ pain; it’s no wonder so many can’t relive their trauma to police and in court.

Bolt is attacking everyone tonight it would seem. He’s recounting how it was impossible for it to occur. He’s filmed things on his phone from the cathedral to show that they could’ve been at the scene of the crime. It’s like he’s a defense attorney.
He’s also drawn diagrams on the map of the cathedral. He will also be naming names of people who have attacked Pell. He also attacked dan Andrews tweet today .

Did you not still see the coverage before that suppression and after? And even during we all knew what they were talking about. The ABC also kept calling these victims.
