Wendy’s Burgers is officially returning to Australia. Flynn Restaurant Group, which operates all 260 Pizza Hut stores in Australia and a number of Wendy’s in the US as a franchisee, will roll out 200 Wendy’s restaurants Down Under, starting from 2025.
How are they navigating the fact that Wendy’s Milk Bar already exists? Will they have to call themselves “Wendy’s Burgers” or something to that effect to define between the two?
Both Wendy’s have longstanding registered trademarks in Australia, and both had recently been renewed, he said. They had been accepted under a particular provision of Australian intellectual property law.
It was therefore likely that the Australian trademarks office had highlighted the possibility of confusion in the marketplace, requiring either further evidence or a letter of consent from the other party Mr. Beven said.
“I think that there has probably already been a deal done, and that Wendy’s Australia has already acknowledged Wendy’s U.S. trademark rights here in Australia and allowed the coexistence,” he said. That would allow the two trademark applications to be accepted and registered unopposed.
So long as the Australian Wendy’s sticks to ice cream and hot dogs, and the American Wendy’s offers burgers and fries, there would be little issue, Mr. Beven said. “I suspect they will both stay in their lanes to try and limit that confusion,” he added.
Existed in NZ together for decades before the SupaSundaes/Milkbar version ceased to exist in NZ in the last 5 years.
Remember the reason was due to Wendy’s Australia not being happy that the franchises rebranded as “Shake Shed & Co” without their permission.
Sorta. It all spun out over a disagreement over ice cream supplier - some franchises changed name/trading name in a bid to void that agreement but didn’t work.

They do, most famously the Frosty (which is sort of halfway between a milkshake and a soft-serve ice cream).
I can see this getting messy if Wendy’s Hamburgers starts putting outlets into food court locations where there may already be a Wendy’s Milk Bar.
