No I feel the same way. However, I do feel for the businesses who are greatly affected. It has also created huge uncertainty for border openings. It has also given me a chance to save money. But really if I wanted to do that and rest up I could have always done a self imposed lockdown. At the end of the day the implications for snap lockdowns are huge.
Iām not hysterical Iām angry. We should never have been placed in this lockdown even if it is just 5 days. The impact is very broad and itās been clear that the contact tracers had their arms around this. Itās a very expensive and damaging insurance policy.
If this happens again will the government continue to wet the bed?
From all accounts that are leaking it sounds like we will snap back to last weeks settings which is a good thing.
I donāt get it, owners of businesses say that they wonāt be able to pay rent if they donāt open so how are they going to pay the fines theyāve received for opening?
Itās actually costing them more to open while risking a fine.
Apparently fines Victoria are telling people to appeal the fines.
Maybe the federal government could had tried a wealth tax where businesses who increase profit during the pandemic have to pay a one off higher tax and that money from the higher tax for wealthy people and corporations gets redistributed to smaller businesses.
By going to court?
Apparently. There must be cases where people have appealed and had the fine squashed.
That is the only good aspect - it forces you to stop and slow down. For a few days itās not too bad from that perspective. Lockdown also feels different in summer⦠like it didnāt feel as much that I was in lockdown cos the days are longer and the weather was nice. This one though was more just frustrating that it happened on a particular weekend that I had a few things on (like the Australian Open amongst other things).
Most of the time when these businesses operate and the media make a big deal of it, the LNP or some of these far right groups have something to do with it.
Could also backfire and result in a larger penalty.
How? There is an option to appeal.
There would be a defined number of penalty units for the fine. I donāt think a court could increase the fine. (?)
Donations from the far right for participating in a media stunt. Thereās no doubt these places arenāt illegally opening without a bit of fanfare to get the journos to turn up.
Itās also free advertising to those who are like minded who might wish to support such a business once the lockdown is overā¦
According to ABC News the lockdown will end tonight with Daniel Andrews to address how later this morning.
10;15am-ish it has been reported
Thanks I havenāt seen any confirmation of that so didnāt state it. Soon then.
Well they can ask for a review but if they elect to have the fine heard by a magistrate the penalty may be different.
From Legal Aid Victoria if you elect to take a fine to court. One would assume breaching the CHOās directions would be the same as any in the spot fine.
What happens at the Magistratesā Court?
Going to court means you get to tell your side of the story to a magistrate or a judicial registrar. They then make a decision about what you must do.
The magistrate or the judicial registrar can decide to:
- cancel the fine
- take away the extra costs
- order you to pay a smaller fine.
However, the magistrate can also decide to:
- give you a larger fine
- make you pay for the court costs
- cancel or suspend your driverās licence
- record a conviction against your name.
If you have to pay, you can ask for the amount you owe to be converted to a community-based order. Ask for the court registrar at the Magistratesā Court to apply. You must agree to the conditions of the order. You must also have enough free time to do the community work.
If you are found guilty, it may appear on a Victoria Police criminal record check.
Andrews has confirmed from 11:59pm tonight the statewide lockdown will come to an end.
