Yes, Seven did provide him an opportunity to produce some specials and host a successful reality show, along with a Logies appearance.

Im sure he was paid well for the last two years and had a small uptake in his subscriptions. But I guess he does have the rights to protect his properties.

Somers has a reputation for being fiercely protective of the Hey Hey content - his response is pretty well consistent with previous instances too

Have you ever heard of ‘fair dealing’? The way the clip was used is the very definition of using copyrighted material for the purposes of commentary.

Those interviewed were taking about a specific moment when John Farnham met and sang with his idol - Tom Jones.

In my opinion he has no case and I’m glad seven are fighting it.

And just to declare I produced that Spotlight special.

[Somers Enterprises Australia] is claiming “damage to SEA’s commercial reputation by broadcasting and streaming inferior quality footage of the performance” and missing out on profits “as people who would have paid to subscribe to heyhey.tv in order to watch the performance … will not do so because they viewed the performance for free on the Seven program.”

Absolutely bizarre and extremely over protective… I doubt anyone was going to subscribe to watch one thing, and I doubt anyone will think negatively of Daryl because Seven aired whatever footage they had on hand…

And ultimately that may be the finding of the court, but clearly, the representative of the entity that claims the copyright doesn’t agree and wants to try and assert their rights.

These kinds of cases can be valuable for clarifying what fair dealing is or isn’t in the eyes of the courts - while it can appear to be petty or vindictive,

Who would pay to watch it on his site when there are several uploads (and reactions) on YouTube, far predating Seven’s use of the clip.

My comment was in response to ‘Somers might have a case here’. I was just expressing my opinion that I don’t believe he does.

The group Hey Hey Forever was shutdown (which I was a part of) due to copyright claims from Somers-Carroll

Ever since GTV banned him from getting his free haircuts, Somers has been more careful with his money.

It was well known after Hey Hey wrapped in 99 he would still go on for regular haircuts.

Lehrmann said Seven had agreed to pay for his accommodation for a year to June 2024.

Seven has previously said in a statement: “7News Spotlight made no payment to Bruce Lehrmann for the interview, however the program assisted with accommodation as part of the filming of the story.”

I think Seven is being a bit fluid with its wording.

“assisted with accommodation as part of the filming of the story” is IMO something akin to paying for hotel accommodation for a few days while said person may be away from their place of residence for the purpose of said interview, and I would think entirely appropriate.

But paying for said person’s rent for an entire year after the interview is done, is a very different idea.

I does mean that Seven are paying Lehrmann right now and for another 7 months. He said didn’t know how much Seven were paying as the documents were obtained via a subpoena from Seven.

There was some discussion today about keeping some information confidential. Appeared to be about other cases that had been settled with a decision yet to be made. So more info may come out.
